The Vigo County Commissioners on Tuesday lifted their “stop-work order” on Cobblestone Crossings, a residential and commercial property development south of Terre Haute.
The commissioners, who are the legislative body for the county, cited plans for an 8-foot-tall wall dividing Cobblestone apartments from the neighboring Woodgate subdivision as the reason for lifting the order, which went into effect on Sept. 13.
Commissioners Judy Anderson, Paul Mason and Mike Ciolli announced the decision in a statement issued Tuesday.
Charlie Williams, president of the Woodgate Homeowners Association, praised the the move.
“We have worked to find a mutually satisfactory compromise and we commend the commissioners for requiring the buffer,” Williams said.
Woodgate residents have opposed two-story apartments being built at Cobblestone Crossings near their property lines saying the apartments decrease Woodgate homeowners’ property values. They also have complained that they believe the apartments are being constructed in areas legally zoned for single-family homes and condominiums. And they have pointed to an alleged conflict of interest involving a zoning commissioner who took part in decisions favorable to the Cobblestone development.
In the county’s stop-work order of Sept. 13, the Vigo County Area Planning Department, which issued the order, stated that the alleged conflict of interest by a zoning commissioner “cast doubt on the legitimacy” of past zoning changes that allowed Cobblestone to develop. Because of that, Cobblestone effectively reverted to an agricultural zoning and the developers would be required to come back before county officials for new zoning hearings, the stop-work order stated.
The commissioner’s statement of Tuesday did not directly address the zoning question, stating only, “The developers of Cobblestone will still be required to bring this submittal before the Vigo County Area Plan Commission for the current phase of construction to deal with the issue raised in the last Area Plan Commission meeting.”
All zoning changes in Vigo County must first go before the Area Plan Commission for a hearing.
Woodgate residents had earlier asked Cobblestone to bear the cost of building a wall between their property and the new apartment buildings. Mike Poinsett, president of the ad hoc neighborhood association opposing the new apartments, could not be reached for comment late Tuesday.
According to the commissioners’ statement, the 8-foot-tall masonry wall will be at least 15 feet inside Cobblestone’s property line. The commissioners also reserved “the right to review this decision as matters progress.”
