Farmersburg man arrested on rape charge

TERRE HAUTE — A Farmersburg man has been arrested on suspicion of rape and criminal confinement after a May 4 incident that allegedly occurred at his parents’ residence.

Matthew James Maxwell, 22, appeared in Vigo Superior Court 3 on Tuesday where he told Judge David Bolk that “it was consensual.”

But a probable cause affidavit filed by Detective John Childs of the Vigo County Sheriff’s Department quotes the victim as saying Maxwell invited her to his house to watch a movie and later pulled out a hunting knife and forced her into his bedroom.

The victim told Childs that Maxwell became increasingly violent when he smoked a substance while they were watching the movie. She stated that he also handcuffed her for a while during the incident, and refused to let her leave his parents’ home.

She was later released and reported the incident to police on May 7.

Childs reported that he interviewed Maxwell, who admitted that while the alleged victim was at his home, he smoked a synthetic marijuana called “black magic” or “black smoke” that he had purchased at a convenience store in Terre Haute.

An arrest warrant was issued for Maxwell, and it was served on Monday by the Indiana State Police and the Sullivan County Sheriff’s Department. Maxwell was located at the home of a girlfriend in Farmersburg. He was taken into custody around 5 p.m. and taken to the Sullivan County Jail. He was later transferred to Vigo County.

The rape charge is a class-A felony punishable by 20 to 50 years in prison, while criminal confinement is a class-B felony with a sentencing range of six to 20 years in prison.

Bolk appointed a public defender for Maxwell and set his next court date as June 12 in Vigo Superior Court 1.

Bail for Maxwell was set at $75,000 with no 10 percent allowed.
