Change of venue requested in child neglect case

TERRE HAUTE — A change of venue has been requested for a Terre Haute teen accused of child neglect related to the December 2011 injury of a 7-week-old infant.

Jesse James Weir, 17, appeared Monday in Vigo Superior Court 3 with attorney Mark Stalcup to request the change of venue because of pretrial publicity.

Judge David R. Bolk set a March 5 hearing date on the request.

Weir had been set to go on trial Feb. 26. However, Bolk reset the trial date to Sept. 10.

Weir was waived into adult court last December to face a class-B felony child neglect charge.

The investigation by Detective Rick Decker of the Terre Haute Police Department indicates that Weir was involved in the injuries to the infant, who was hospitalized with fractures to her skull and ribs as well as numerous other injuries.

Because Weir is a juvenile, the case was originally filed in juvenile court, but was later waived to adult court. Decker said the criteria for being waived to adult court include that the crime is a class-A or class-B felony if committed by an adult, that probable cause exists that the suspect committed the crime, and that the suspect is at least age 16.

Weir is free after posting bail.
