TERRE HAUTE —
A mistrial has been declared in the trial of Richard L. Boswell Jr., according to a Tribune-Star reporter in the Vigo County Superior Court 6 courtroom.
Boswell, 55, faced a charge of murder in the May 22, 1979, death of Kathy Jo Baker, 20, and attempted murder of her son, Ryan Baker, then 2 1/2.
A witness for the prosecution, Jody Bennett, a convicted killer, testified about a conversation he said he had with Boswell while they both were incarcerated. Bennett testified that Boswell told him that Boswell was in prison “for killing another woman.”
Defense attorneys then objected in court today because of a prior motion that Boswell’s conviction on criminal deviate conduct and criminal confinement not be made known to the jury because it would prejudice the jury against the defendant.
Judge Michael Lewis then took a brief recess before declaring a mistrial.
Lewis set a new trial date of April 1 and ordered Boswell held without bond at the Vigo County Jail.
