Defendant in slain officer case seeks change of venue

TERRE HAUTE — A change of court venue will be requested for another defendant accused of assisting a criminal in the July 11, 2011, death of Terre Haute police officer Brent Long.

Heather Elkins, 24, has been charged with possession of methamphetamine, maintaining a common nuisance, receiving stolen property, resisting law enforcement and possession of paraphernalia.

Her July 30 trial date in Vigo Superior Court 6 was continued. On Monday, defense attorney Luther Garcia told the Tribune-Star that he intends to request a change of venue for the case. Elkins remains in federal prison after pleading guilty to making a false statement to authorities. Her release date is Aug. 22.

The Vigo County criminal cases against three other defendants charged in connection with the death of Office Long — Jenny Torres, Charles Elkins and Jesse Padgett II — have already been venued to Monroe County.

Five people — Heather Elkins, Charles Elkins, Padgett, Torres and Roberta Utterback — were inside a house on North Eighth Street on the day that a federal fugitive task force arrived to serve an arrest warrant for a wanted suspect. All five people were removed from the house, and did not indicate to police that the wanted suspect was inside the house in possession of a handgun.

During a search of the residence, Long was shot and killed by the suspect, who later died of a self-inflicted gunshot wound.
