Shooting, chase leads to 23-year sentence

Brazil man enters plea agreement

TERRE HAUTE — A Brazil man received a 23-year prison sentence for a 2010 incident in which he shot at Terre Haute Police during a car chase on the city’s east side.

Douglas Fulk, 32, had been scheduled for a Feb. 13 trial in Vigo Superior Court 6, but a plea agreement submitted to the court Jan. 19 allowed Fulk to avoid two attempted murder charges if he pleaded guilty to attempted aggravated battery and resisting law enforcement.

On Thursday, Judge Michael Lewis accepted that plea agreement and sentenced Fulk to 20 years in prison for the attempted aggravated battery, with an additional three years for resisting police. Lewis ordered that those terms be served consecutively, and in addition to a two-year sentence recently imposed by a Clay County judge. Fulk violated his probation in Clay County by being charged with a crime in Vigo County.

That gives Fulk a 25-year prison term, Lewis noted. He is allowed credit for the 742 days he has spent in the Vigo County Jail since his arrest.

Lewis also recommended that Fulk be allowed to participate in drug counseling and mental health programs while in state prison.

Fulk was arrested Jan. 21, 2010, after a vehicle chase and standoff that began when police attempted to make a traffic stop on an auto driven by Fulk. Police had received a tip that Fulk had a machine gun in the car. A chase ensued, during which Fulk allegedly fired the gun at pursuing police officers at three different places.

The chase came to an end in the Terre Vista neighborhood after Fulk bailed out of his auto and burst into a home. The homeowner ran out of the house unharmed, and Fulk barricaded himself inside the house as police surrounded it and called in the Special Response Team.

Fulk surrendered peacefully to police about two hours later.

The original criminal charges filed allege that Fulk attempted to murder police officers Matthew Morgan, Chad Bowman and Adam Loudermilk when he fired a gun at them during the chase.

Three counts of class-B felony aggravated battery alleged that Fulk fired his weapon at the three officers. Another class-B felony charge of burglary was filed because Fulk allegedly forced his way into the home on Lakeview Drive.

In the class-D felony counts, Fulk was charged with intimidation for allegedly threatening Detective Troy Davis to move police away from the residence, for resisting law enforcement by fleeing from police using a vehicle, and for criminal recklessness for allegedly swerving his car toward another officer.

Two class-A misdemeanors were also filed, alleging that Fulk resisted law enforcement by fleeing from officers after they identified themselves, and alleging that he carried a handgun without a license. Fulk had been convicted in October 2006 of the same firearm violation in Clay County.
