State police ticket trucker for speeding, alcohol violation

TERRE HAUTE — A Pennsylvanian trucker was charged with speeding and an alcohol violation while driving near an Interstate 70 construction zone at 9 a.m. Monday.

Indiana State Police trooper Mark Overpeck radar-tracked a semitrailer driven by Max L. Bawell, 42, Willow Hill, Pa., going west on I-70 at 73 miles per hour in a 60-mph zone. The traffic stop was made at the interstate’s six-mile marker, very near a construction zone that includes reduced speeds and lane restrictions.

After the traffic stop, Overpeck “detected the smell of what appeared to be an alcoholic beverage on the breath of the driver,” according to an ISP press release.

Bawell was taken to the Vigo County Jail for a certified breath test. Police said the results showed the driver was in violation of Indiana law prohibiting commercial vehicle drivers from operating a commercial vehicle with a breath alcohol content of 0.04 percent to 0.08 percent.

For the alleged alcohol violation, the driver and semitrailer were placed out of service for 24 hours at the Clear Creek Rest Area on I-70 at the 1-mile marker in far western Indiana. Bawell also was ticketed for speeding.

While inspecting the truck, Overpeck also found log violations, which were noted on the federal commercial vehicle inspection report. No log book citations were issued, however.

Bawell was driving for Chambersburg Transfer LLC, enroute from McConnellsburg, Pa., to Republic, Mo., and was hauling a boom lift machine on a flatbed trailer.

 Overpeck was working on I-70 in the Terre Haute area as part of the ISP Commercial Vehicle Enforcement Division’s Crash Reduction Plan. The plan is part of an ISP effort to reduce the risk of a crash, prevent future crashes, and ultimately save lives on Indiana highways.
