Local attorney to discuss case on NPR

TERRE HAUTE — A nationally-known Terre Haute attorney will be a guest on today’s edition of “Fresh Air,” a National Public Radio interview program, discussing a current challenge to a Supreme Court decision he helped bring about.

James Bopp Jr. will be interviewed on today’s program by “Fresh Air” host Terry Gross, an award-winning journalist. The program, which airs from noon to 1 p.m. EST, can be heard locally on WFIU-FM on 95.1 FM or 103.7 FM.

Bopp brought the famous Citizens United v. Federal Election Commission case to the U.S. Supreme Court in 2010. His 5-4 victory in that case allowed unrestricted political spending by corporations and labor unions under the First Amendment.

Now, opponents of the Citizens United decision are hoping the Supreme Court will overturn the ruling. The nine justices could have that opportunity when they address a recent decision by the Montana state Supreme Court that effectively disregarded the Citizens United and permitted corporate political spending restrictions to remain in place in the state.

Bopp is critical of the Montana high court’s ruling, calling it an “act of defiance of the Supreme Court” and he is hoping the high court will summarily rule in favor of upholding Citizens United. Such a ruling would not require arguing the case in front of the justices, Bopp said.

On the other side of the issue is former Federal Election Commission chairman Trevor Potter, who also will be a guest on today’s edition of “Fresh Air.”

Potter and Bopp were interviewed separately for the program, Bopp said.
