Suspect in fatal shooting at ISU faces trial in February

TERRE HAUTE — A Feb. 25 trial date has been set for a man charged with murder in an Aug. 24 shooting on the Indiana State University campus, near the Ballyhoo Tavern.

William Henry Mallory, 21, appeared via video from the Vigo County Jail for a Monday morning hearing in Vigo Superior Court 6.

Judge Michael Lewis advised Mallory that public defender Vernon Lorenz has been appointed in the case, and that a pretrial conference is set for Jan. 18.

Mallory asked the judge if pre-trial release from jail was possible through home detention. Lewis directed Mallory to speak with his attorney about that request.

Six formal charges have been filed against Mallory in connection with the early morning shooting near the Ballyhoo Tavern at Ninth and Chestnut streets. Dustin Kelly, 24, of Terre Haute was killed in the incident, and Dante Pettus and Terrance Trotter, both 21, were wounded.

Mallory was charged with felony murder; two counts of class-A felony attempted murder; two counts of class-B felony aggravated battery; and carrying a handgun without a license, a class-A misdemeanor. Mallory allegedly shot all three men with a 9mm handgun. Trotter was shot in the hip, Pettus in the torso.

After a court hearing Aug. 29, a fight erupted in the courtroom between family members of Mallory and the victims. Though Division 6 hearings are usually scheduled in the afternoon, the judge conducted Monday’s hearing in the morning in an effort to avoid another disruption in the courtroom.
