Clay man sentenced in 2010 burglary, deviant conduct case

Suspect linked to crime by DNA

TERRE HAUTE — A Clay County man has been sentenced to 16 years in prison after pleading guilty to burglary and criminal deviant conduct.

Daniel Eugene Winn, 47, of Carbon, apologized to his victim during a sentencing hearing Wednesday in Vigo Superior Court 6. Winn also said that he now recognizes that he has a mental health problem that contributed to his actions on July 27, 2010.

Terre Haute Police investigated a report of a burglary at the Village Quarter apartments after learning that about 5:39 a.m., a suspect entered the victim’s apartment through a ground-floor window and was able to restrain the victim with duct tape. The victim told police the suspect rubbed various parts of her body, removed her pants and performed sex acts.

The victim reported the incident and authorities collected a sexual assault kit that contained a sample of the suspect’s DNA, which was sent to the state police lab for testing. In December 2010, the lab notified THPD that a match was found for Winn, who had been convicted of a crime in California. Police were able to locate Winn in Clay County, and collected a sample of his DNA to compare. He was arrested in January 2011 on the Vigo County case.

Winn’s criminal history in California include burglaries in 1987, 1988 and 1996.

The plea agreement called for up to 16 years in prison on both class-B felony charges of burglary and criminal deviate conduct, with the sentences to be served concurrently. The plea also calls for Winn to register for life as a sexually violent predator.

Judge Michael Lewis sentenced Winn to 16 years in prison over defense attorney Jessie Cook’s request for less jail time, in part because of childhood abuse. Lewis noted the aggravating factor that Winn has three prior convictions in California.

Winn has accumulated credit for 414 days already served in the Vigo County Jail.
