Trial date set for man facing battery charge
A Dec. 10 trial date has been set for man accused in two separate violent attacks.
Brian Byron Hiatt, 39, appeared via video in Vigo Superior Court 6 on Wednesday for setting of the trial dates.
Hiatt is accused of class-B felony aggravated battery for a July 2009 incident in which he allegedly attacked a man and wife in their home. He also faces a class-C felony charge of intimidation for allegedly threatening someone with a knife.
The prosecution has elected to pursue the class-B felony charge at trial against Hiatt.
Police find truck that hit adult, 3 children
Police confirm they have found the truck involved in a hit-and-run accident that seriously hurt a man and three children as they fished along a gravel road in southwestern Indiana.
However, an arrest has not been made as of 5:30 p.m. Wednesday as investigators try to determine who was driving the pickup. The truck ran into a group of six people, who were reportedly fishing along the rural road just after midnight Tuesday near the Greene-Sullivan State Forest outside Linton.
The Greene County Sheriff’s Department has not released any new information in the case.
A report in the Greene County Daily World newspaper at Linton quotes a woman who said she was at the scene fishing with her fiancee, Michael Delp, his nephew and two nieces and their mother when the truck came right at them.
Delp and the children were taken to Indianapolis hospitals.
Delp remained in Methodist Hospital on Wednesday. He reportedly has a broken leg as well as spleen and kidney injuries. Injuries to the children, ages 8 through 11, include a broken collarbone and legs injuries.
