Trial delayed a month in ’79 Riley homicide

TERRE HAUTE — A trial date has changed again for a Riley man accused of a 1979 homicide.

An Aug. 6 trial is now scheduled for Richard L. Boswell Jr., 54, who has been charged with murder and attempted murder for the May 1979 homicide of Kathy Jo Baker, 20, in a rural area northeast of Riley. Baker’s then-2-year-old son was also injured and left for dead by his assailant.

The trial had been scheduled to start July 9.

Judge Michael Lewis reset the trial date in Vigo Superior Court 6 on Monday. Members of the victim’s family were present in court when the trial date was reset.

Boswell was arrested in October 2010 after laboratory testing identified his DNA on a shirt that Baker was wearing when she died.

Boswell, who has served about 15 years in the Indiana Department of Correction on a 1991 conviction of criminal deviate conduct and criminal confinement, is a registered sex offender. He resided in the Riley area in 1979, and was residing with his parents near Riley when he was arrested  in 2010 by the Indiana State Police.

Boswell is now being held in the Vigo County Jail with no bail set.
