Man accused of striking child sentenced

TERRE HAUTE — A Terre Haute man accused of striking his stepchild in the head with a hammer has received a six-year prison sentence.

Charles McVay, 27, will serve four years in the Indiana Department of Correction, followed by two years on probation, according to the terms of a plea agreement reached in August.

McVay pleaded guilty to a class-C felony charge of battery by means of a deadly weapon in Vigo Superior Court 6. He has already served more than one year in the Vigo County jail awaiting trial. The time he has spent in jail will be credited toward his prison sentence.

Court records state that on Aug. 30, 2009, McVay allegedly hit the child in the head with a claw hammer and shoved the child into a wall. The incident occurred when the child tried to defend his mother, who was arguing with McVay about a cell phone. The child has since made a full recovery.

McVay was charged with battery by means of a deadly weapon, a class-C felony, and battery resulting in bodily injury, a class-D felony. However, the plea agreement dropped the second battery charge.
